I [heart] SCTOUSblog.

Plus it's nice that the nomination proceedings will be covered by a group of people who really know what they're talking about, and have the knowledge and resources to do in-depth analysis.

These guys are supergeniussmart - they are involved in one side or another of a surprisingly large number of argued cases, and the #1s at Harvard and Stanford were summer associates last year. not jealous or anything

They've convinced me that Judge Garza will be the next chief, considering that he is Hispanic and has as strong anti-Roe credentials as anyone else in the federal judiciary. Should make for a brutal confirmation fight, though.

I suspect Bush may nominate himself, and serve simultaneously as Commander-in-Chief and Chief Justice.

One point re: Gonzalez.

He was at SMU law school a couple of years ago, and I spoke with him afterwards. I didn't ask him whether he thought he would make it to the Supreme Court because that is what he is always asked. I asked him how he felt about all the attention he was recieving regarding the Court and if it effected how he presented himself and his thoughts. He smiled nicely and said it would be a lie if he didn't admit being on the Court was his dream, but he didn't think it would happen, so he wasn't pursuing it. Good political answer. And the guy short. Real short.

I suspect that Bush will choose a younger and more academically/ideologically prominent judge to fill the Rehnquist vote (the Rehquist seat might well be filled by elevation of Scalia or Thomas, leaving the Rehnquist vote to be filled by a new nominee). Senate Democrats will be less-inclined to make trouble when it is a right wing vote being replaced. Wilkinson, Luttig, and McConnell have to be your leaders.

Garza's best held in reserve to replace John Paul Stevens, should he retire in the next three years. His being somewhat older and Latino will make it an easier thing to sell to the Senate, who certainly weren't happy the last time a vote moved left to right (Thomas's nomination to succeed Marshall in 1991).
