Why Is Walmart Upset with a Guy for Photoshopping This Picture of a Horse in Front of One of Its Stores? He was hanging out with some friends in July when they came across .horse and thought it was pretty much the funniest top-level domain one could own. So Jacques started checking periodically to see what big companies hadn't purchased their .horse domain yet and came across Walmart. "I thought, 'Alright I'm gonna buy this and do something stupid with it and see what happens," he told me. And readers, he did just that.

This longer, more in-depth article states:
The company is giving him 14 days to stop using the domain name in any way, but Jacques believes he’s within his rights to use the Walmart name because his site is too ridiculous to be confused with something operated by the retailer.

“I would argue that Walmart.horse is an obvious parody and therefore falls under fair use,” ...

I don't usually shop at Walmart. Before today, I would absolutely have shopped at Walmart if I was a horse. But now? Now I don't know what to do.

The boring bit is that Walmart is obligated to protect its trademark - that is one of the fundamentals of trademark law. So the CnD is cookie-cutter and, imho, unlikely to result in any sort of protracted legal kerfuffle.

Here's his website. It is not very functional, unless you want to look at a picture of a horse photoshopped into a picture of a Walmart, in which case it is extremely functional.

What I don't get is why walmart.horse appears to be running tumblr CMS to host the picture. I am surprisingly angry about this.

On a more serious note, this brings to mind a ham radio operator who registered a domain with his FCC-assigned callsign N7QVC. You'll never guess who came knocking with a cease and desist....

It probably costs a couple of bucks more per sign to do that. I've been to Wal-Mart-- that's one of the least-egregious atmospheric corners that they cut. You might as well complain that your local crack house has a dirty bathroom.

Dear Walmart,

I think it's great that you guys have electrical hookups for RVs so people can travel around the country and stay at Walmarts. I'm traveling by horse and buggy. I saw on Walmart.horse, that there's at least one other person who travels by horse to Walmart.

How about some hitching posts in front of Walmart? There's those blue cement things in front of your store, but any half-smart horse can just yank the rope up and out of there. Don't think your designer ever dealt with a horse at all, it just won't work.

Also a horse trough would be nice and can you please keep the kids from throwing trash in them or pennies. A horse trough is not a wishing well.

I promise to clean up after any accidents and buy lots of stuff from Walmart when I'm there.

Sometimes stuff like this really irks me:

To be clear, Jacques is 34-year-old with a nose ring who lives in Massachusetts and makes all his money by publishing a webcomic called Questionable Content online. Walmart has more than 11,000 stores in 27 countries, and in 2012, it was reportedly the valuable retail brand in the United States, with a value of $139 billion.

The thing is, that is the whole point of the cease & desist letter. You have to protect your trademark or you're screwed. Sure it's funny. It's absurd so it's funny. But the site name is WALMART.horse. Of course they're going to try to get him to take it down. And to act like the fact that he's a little guy and they're a big corporation means that they're just being ornery and quashing creativity for no reason is completely disingenuous.

A lot of corporate names that you will never get to use just came through (.oracle, .java, .epson, .nissan and their long abandoned name .datsun).
Also .SUCKS which is not yet officially available from any registrars I see, and has been subject to some controversy.

If I put ol' Swisher into a fox trot, it take me maybe 40 minutes to ride down to Wal Mart from here. If I go back behind the reservoir, there's only about 1/2 mile of where it's crowded down by the truck stop, and he's good about traffic. Conversely, I could take a picture of him when I trailer him out to the arena to work.

There is a quote by Jon Postel floating around about how constraining TLDs is arbitrary and there's no longer many good reasons for it.

Personally I'm looking forward to the introduction of non-Latin character TLDs, which will allow a string like http//:ಠ.ಠ to be a legal URL.

There were non-Latin gTLDs in the first round, back in 2013. (The xn- strings are the Punycode encoding of the gTLD.)

شبكة (xn--ngbc5azd) – Arabic for "web/network"
онлайн (xn--80asehdb) – Cyrillic for "online"
сайт (xn--80aswg) – Cyrillic for "site"
游戏(xn--unup4y) – Chinese for "game(s)"

There's now about 40-ish. I suspect you mean arbitrary Unicode gTLDs, which between IDNA2008, the gTLD application process, and the fact it costs $185,000 to apply, is going to weed out gTLDs like .ಠ and .💩. It's funny, but it's not 185 grand funny.

Me too. Anyone could have spent five minutes to learn the required HTML to hand code a simple, elegant page showing the image. The tumblr cruft on the page is a huge distraction and makes it look like there's more to the site than there is, or should be. Arguably, this bolster's Walmart's argument about likelihood of confusion.

And now I wonder if if there is a German word to express the admittedly slightly irrational sense of frustration that Going to Maine and I experience in this situation.

There is a quote by Jon Postel floating around about how constraining TLDs is arbitrary and there's no longer many good reasons for it.

I can think of at least one good reason: it seems like it makes spear phishing attacks much more likely. I mean in the case linked in the FPP, the site owner had innocent intentions and the TLD (.horse?) was silly enough that nobody would probably believe it really belonged to wal-Mart. And this is a fucking giant company - if anyone has the resources to go out and register their trademarks in every TLD that comes out, it would be them. Imagine a smaller business, or a local credit union, or a doctor's group, that doesn't register their name on one of the dozens (hundreds?) of new TLDs. Now some black hat can do so and start emailing people from an email address that isn't obviously fake, or set up a bogus but official-looking webpage and count on people not paying close attention to the green name on the certificate in the address bar.

I know the domain crunch was getting serious, but we started with, what, 3 TLDs that any average person could register (.com, .net, .org... Were there more that weren't reserved like .gov and .edu? Either way, a handful). And there are millions and millions if not billions of domains under that system already. So you could triple that potential namespace by adding 6 new domains, and it would still be manageable. Hell, 20 new ones would probably be manageable. But how the fuck money are there now? And is there any end in sight?

I assume that he wants to keep it separate from the QC webserver; bandwidth and liability both seem like adequate motivations for that. And considering that it's a throwaway joke site anyway, why not Tumblr?

Re Tumblr: Like at least one other web comic artist that I know of, he seems to use Tumblr as a back-up site when he has issues with the main site for his comic for some reason. I read QC regularly, but I don't fanboi him too hard as far as following his Tumblr site and a zillion other things he does, but my impression is that he does have a personal Tumblr site.

So I am guessing he put it there in part because Tumblr is free and apparently something familiar to him.

Also also, it is my general impression that his ex-wife was the person who originally did the code work for his comic. He apparently knows a bit of html and all that, but there may be serious limits to what he can do as a webmaster. The degree to which his professional work is custom coded may be something he now (post divorce) has to pay for or it may take a LOT of work on his part to create. Whether it represents loads of time or just a bit of money, I don't see any reason why he would invest that much in a one-off joke site.

For a throwaway joke, Tumblr seems like a perfectly reasonable choice.

Jeph Jacques has also started another webcomic, a sci-fi fantasy thing titled Alice Grove (currently on a slow story reveal with a couple alien 'tourists' who can't get out of a rural Earth area that has some pre-existing weirdness) that is also hosted on tumblr. Please remember, the characters of QC have always been kind of 'slackers' and after 12 years, Jeph has committed to a low-impact lifestyle himself.
