Little choice they have.
When crack dot com's server got broken into and the full source for Quake II was stolen, and instantly spread out among the hacker community, there was little id could do besides grin and bear it. When ports to Linux and OS/2 appeared, they accepted the fait accompli and turned their heads.
Had they made nasty, all that would have happened is to alienate their customer base. They really had little choice but to ignore the whole thing. Of course, suing crack dot com (which they had every right to do) would have accomplished nothing.
So it is here. If Apache makes nasty, all they do is make themselves look bad.
